Rasheem Dunn Waiver Denied (APPEAL WON)

Eli Wright may have been able to get a waiver for hardship reasons. His mother passed away last Christmas. He is the legal guardian for his younger brother who lived with him during the second semester last year and then returned to their home in Kentucky. If Eli stated that he was transferring back home to a school in Kentucky in order to be closer to his younger brother who is a minor, it would probably have been granted since he is his brother's legal guardian.

I did a quick search and found one similar case — and it is not a good omen for Dunn.

- Kid plays for 3 years at Louisville, where Richard Pitino is assistant coach to his father. The younger Pitino takes the head coaching job at FIU and the kid follows him there.

- Kid sits out his first year at FIU according to the transfer rules.

- After the one year is up, Pitino leaves FIU to take the head coaching job at Minnesota.

- Kid wants to follow Pitino to Minnesota and applies for an NCAA waiver – on the basis that he’s already sat out a year and the coach he wanted to play for is now gone. Plus FIU is now banned from postseason play because of stuff that happened before Pitino arrived. So it’s a complete sh*tshow at FIU.

- NCAA denies the waiver. Minneosta appeals and NCAA denies the appeal.

Good points PS, the three differences I see--major or minor depending on one's view--is 1) Felton was fired in July--he didn't 'leave';2) Pitino left FIU in April, and 3) CSU's program was in a free fall at the time of Felton's firing Allegedly because of 'hard' practices, lol) with ~ 6 players left on the roster when Felton was terminated, and only 3 on it when Gates was hired on 7/26. (Rasheem entered the portal on July 13 and committed to St. John's on Aug. 2.)
Seems to me that Rasheem was a victim of both the imploding program and Garrett's vindictiveness to strike back at a kid in 'waiver limbo' because of the NCAA's dismal record in 'consistency' over the years.
At the least, if they're going to compel Dunn to sit a second year, he should be given back that 'lost' year of eligibility.
Here's hoping for the best for Dunn.

The waiver for immediate eligibility by Moore has nothing to do with playing 3 minutes. He is looking to get that year of eligibility back because he was shut down last year because of injury. So he hopes to use last year as a medical redshirt. You can do that if you play in less than 1/3 of your games and you have a legitimate injury that prevents you from playing further. But that has ZERO bearing on why he got his waiver for IMMEDIATE eligibility. That is just to get his year back.

He got his waiver because of hardship. He transferred to Clemson to be closer to his home of Macon, GA. He had family obligations. So this was a hardship waiver.

Good news from what I am told he was initially denied immediate eligibility and they appealed and he won. From what I am told SJU is confident Dunn will win his appeal.

Great input. Thanks Fordham. I still find it odd though, in that Steere 'lost' his 'freshman' year + 1/2 of a 2nd year for playing 5mpg in 1 game. 'Injury' on appeal makes all the difference, lol.

I didn't realize that. I guess he was battling his injury through 1st semester as well and shut it down following that one 2-minute stint? Dunno. I don't begrudge the kid his waiver; just wish there was a 'grid' for measuring consistency in these decisions.

But even if he was not granted a medical redshirt for last year that does not change the fact of why his waiver was granted for immediate eligibility for this year. The only thing that would change is he lost a full year of eligibility for playing 3 minutes last year in addition to be able to play immediately this year. One has nothing to do with the other.

As for Steere not sure what his status is on getting the NCAA to declare last year as a redshirt year despite playing 5 minutes. But since he was not injured not sure what grounds he would have to get that year back.

Remember as soon as you step on the floor in a live game you immediately forfeit any chance you can redshirt. At least in basketball. Football changed their rules on that. The only exception is medical. So if you play I believe in fewer than 1/3 of your games that season and suffer say a major ACL injury you can petition the NCAA to get that year counted as a redshirt year.

Thanks Fordham96 & Paultzman for the news on administration optimism regarding appeal of waiver denial. I'll be interested to hear the basis of the decision once made, but in the meantime I'll just hope for the best.

True, bama & a factor that makes me nervous also, but it may be that now that they know the grounds, the basis of the argument that led to the rejection, they have persuasive counter arguments and evidence.

I'm also curious about the timing of a decision on the appeal--likely on an expedited schedule-- but sometime in the 1st Semester or about when Steere can play?
Let's hope it's good news and sooner rather than later.
 
For the record. Here is the rule in question. Notice the phrase "incoming freshman." Also notice the fact that with the rule in place student athletes in that situation no longer have to apply for the waiver. Think about it, if it is a rule why would you need a waiver??? The fact that Dunn has to apply for a waiver shows you his situation is not what the rule covers by definition. Again it was meant to address what happened to Braxton Beverly in 2017 at Ohio St and then he went to NC St. I am not suggesting Dunn does not have legit grounds for a waiver especially in light of other cases, I am just saying the new rule simply does not apply to him.

Student-athletes in some specific situations can now transfer and compete immediately without a waiver, the Division I Council decided this week. The Council met Thursday and Friday in Indianapolis.

Incoming freshman college athletes who have enrolled in summer school and received athletics financial aid can transfer and play immediately without a waiver if their head coach departs before the first day of classes for the fall term. Additionally, walk-on student-athletes on teams that provide athletics aid and nonrecruited walk-ons can transfer and play immediately without a waiver. Those rules are effective for students who transfer to new schools this fall.

The changes were supported by the Division I Student-Athlete Advisory Committee.

Yup lawyers are already being talked to. Last I heard, he was going to take them court. Hopefully the pressure on the NCAA pays off.
