No jury in arbitration. Most likely a panel of 3 arbitrators, one of which will be hand picked by SJU. Not sure what claims are asserted, but step one would seem to be to try to get the demand for punitive damages knocked out on an early motion (because that remedy is unavailable for a breach of contract claim and/or because whatever claims are asserted to support it are facially deficient). Once that is accomplished, there is very little downside in continuing to arbitrate the $11M breach of contract claim (although, if the school loses, it will likely have to pay MA’s attorneys’ fees and pre-judgment interest at the rate of 9% per year on the $11M).He is way high up, so any praise is coming from below and not above, perhaps out of fear.
In terms of punitive damages, unlikely or not, it's really just a warning to SJU saying, you really don't want to go to trial and risk that, do you? A sympathetic judge and jury could hear how a large Catholic University sought to defame a coach with a squeaky clean resume in order to avoid its contractual obligation to a well regarded minority coach. Consider that if he loves to coach (reference Rollie, Calhoun) an arbitration settlement would permit him to seek employment elsewhere and not have that salary count against the payout. The risk of trial may be minimal in terms of punitive damages, but it's real all the same.
Pitno getting hired has nothing to do with anderson’s claims. It’s like Anderson saying I might be guilty but look who the school hired he has been worse than me.Here is the problem for St Johns as I see it. They talk about poor academics but as far as I know all the former players are eligible at their new schools so far. There were suspensions of players last year. A player did something wrong and there were consequences.
If St Johns would have just paid Coach Anderson what he was owed, this would all have been over and we would be looking forward th the upcoming season. Instead the school is facing a lawsuit which is dredging up unsavory parts of Pitino's past. The part of the lawsuit that mentions hypocrisy is going to get a lot of attention. Realistically, which is worse, having a few players blow off classes of having members of your staff pay for strippers and prostitutes for recruits?
St Johns tried to play hardball with Coach Anderson and there is a definite possibility that they may lose.
Which we will probably only hear in small doses because of the non-disclosure clause that will be contained in the agreement the parties will reach prior to an arbitration decision.Let’s wait for………. The rest of the story.
I can’t comment because of the lawsuit but it is my understanding that St. John’s claims will be more than just cutting a few classes/academics. It has to do with Anderson himself, stuff obviously Anderson’s side left out of the article. By no means am I saying Anderson is a bad man and if what I heard is true I feel a bit sorry for him. Here is the problem for St Johns as I see it. Right, cuz Musselman runs the cleanest ship in the docks...A few comments on Hogville from a couple of Mike Anderson's biggest detractors when he was at Arkansas:
"I understand a school for wanting to fire Mike Anderson for not being a very good coach, because he's not. But saying that he's not a good role model or that he is a failure in creating and supporting an environment that strongly encourages student-athletes who are in the men's basketball program to meet all university academic requirements, well, he seemed to do that here at Arkansas."
And another........
"The kicker is the school initially offering a buyout less than what MA was owed. In my mind, they would have fired for cause initially if they had the evidence to do so.
Also, stating "failure to perform your duties and responsibilities in a manner that reflected positively on St. John's University ... in actions [that] brought serious discredit to the school" then immediately hiring that vampire is laughable. I hope MA gets everything he's asking for, though I'm sure they will settle for less than the $45.6M."
"There's no doubt in my mind pitino will have more success there than Mike. What he will have to do to get recruits there is what's questionable"
