Call me crazy, but I have a gut feeling something positive may happen since the media is starting to reveal how lazy and unprofessional the NCAA is regarding this situation. Maybe there is a rule he broke but gets a special condition for since his parents both died and he was supporting his family at the time? It would be totally cruel and almost sadistic to not let this kid play after all he's been through. It's not like he intentionally tried to gain any advantage or did anything bad. From what I understand he likely played for money to support his family at some point. Hopefully the NCAA has a heart, but I won't be holding my breath assuming that.

After all the frivolous lawsuits in America, this is one that could actually be legitimate. Think about it...this kid was supposed to have 1 year to play ball and has already missed 1/2 of the season to play in front of NBA scouts. I believe the minimum NBA contract is something like 1 million and that's what the NCAA can be costing him. He also did not seem to benefit in any way from anything he did in the past and it was only a means of supporting his family. I'm no lawyer, but it would appear that with a good lawyer he may have a case. This is it for him...pretty sure he can't play as a 25 year old for any college team.

And what exactly would you be suing for? Defamation of character??? There really is no legal matter. There is no guarantee that he would have made it to the NBA, so you can't sue for damages for that. You can't sue because of something that potentially could happen....

Age discrimination? It seems they simply don't believe him because he is an older student athlete and that there "must" but something awry. They have seemingly been unable to come up with any verdict simply becaus of lack of evidence of wrongdoing thus far. Hey, I don't know exactly what is going on behind the scenes, but the NCAA has hijacked thus kid's playing career and unable to come to a timely resolution. If they couldn't disqualify him by now, they should be clearing him.
 
One can articulate a couse of action to justify a lawsuit. The problem is where does Orlando get the money to pay for a lawyer? If he gets free legal services, is it receiving improper benefits? If the NCAA doesn't capitulate, how long does it drag out and does it help Orlando get on the court any faster?

Exactly, if he is declared ineligible he will have to pay the school back the cost of tuition for the first semester. He can continue in school s long as the NCAA does not rule against him.
 
He played for 2 years at a community college , does the NCAA have authority over community college athletes ?
I got no respect for the NCAA, they let football schools make a mockery of college sports/academics and they go all out and screw the athlete because of minor issues.
 
what I'm confused about is how Brandon weeden gets paid to play baseball, then when he fails at it, goes back to college at 25 and gets a full scholarship and plays ncaa football until 28 years old...it's an effn joke and a travesty...fuck the ncaa...too bad Orlando isn't a white football player or he would've been cleared with 4 years of eligibility

For one, he can show that everyone else received a decision but him. They seem to have just tossed his case in the "to do later" basket. Another thing he can say is that no evidence has been found at this point that can incriminate him, yet he is still being held out. I'm sure some lawyer could find a loophole that the NCAA messed up. If OJ and Casey Anthony can get away with murder, Sanchez can successfully sue them.
 
No evidence means nothing w the NCAA. You are guilty untill proven innocent. What a travesty.

No Joe, he can't. Sanchez may have other grounds for suing the NCAA, but not for taking too long. There is no right to due process in a private organization. It's just like the Boy Scouts, they can take 10 years to determine if you qualify to be an Eagle Scout. It doesn't matter, they are a private organization.

The problems arise when you consider that the NCAA has market protections (anti-trust) and benefits from tax exemptions, And that's a larger suit that honestly has little chance of success.
Essentially, we let Congress bestow this power on the NCAA and it will take a miracle to roll it back.

Thought I heard the two exceptions are Military service, and religious delays (i.e. Morman missions). But I'm not sure age IS the deal with Sanchez - I think it's the "5 years of college to play 4" - and whether his 5 years have passed.

I believe you are correct CR on all counts. We can blame the NCAA all we want but our compliance folks at St. John's outright suck! When a prospect is vettted he is to be vetted as if the school IS THE NCAA! All his Dominican course work should have been on the table and not just the Monroe records given his age.
