He can apply for a waiver but I think the free 1-transfer rule is what it says it is and applies to both undergrads and grads.

Remy Martin's current focus is on playing professionally next year, per his father. 

His decision on whether or not he plays an additional year in college will hinge on how he performs during the NBA Draft process.

I first thought he was coming back to New York. Didn't realize there's a Union in Kentucky. I'm sure New York's Union College is a way better school, though.
